Michael New Day - Seventh anniversary

On this day, seven years ago, Army Spc. Michael New reported to formation of his unit in Schweinfurt, Germany, wearing an authorized Battle Dress Uniform (BDU) in compliance with Army Regulations, including a green cap and a U.S. flag on his right shoulder.  He was removed from the formation by a sergeant, placed under base arrest, and charges were filed.  His crime?  He refused to wear an unauthorized U.N. blue cap and a U.N. patch on his right shoulder.  And he refused to report to a commanding general from Finland.

Thus began the seven year legal battle of the only American soldier ever arrested, and convicted, for attempting to serve his own country, and to be loyal to his own oath of office.  Let's look at that oath of allegiance:

• "I, ___________, do solemnly swear (or affirm) that I will support and defend the Constitution of the United States
• "against all enemies, foreign and domestic;
• "that I will bear true faith and allegiance to the same;
• "and that I will obey the orders of the President and the officers appointed over me;
• "according to regulations and the Uniform Code of Military Justice."

It is interesting to note that every single time the Pentagon makes a statement on this case, they quote the third clause of that oath, and ignore the fourth.  But NO order that is not consistent with "regulations and the Uniform Code of Military Justice" may be lawfully given, nor must it be obeyed.  It is certainly true, one disobeys such an order "at one's own peril," subjecting themselves to prosecution and possible penalty.  A price Spc. New was not afraid to pay.

Not everyone agrees with Spc. New.  A retired Air Force pilot once said to us that he did not believe Spc. New had much support, if any, among veterans, and he was absolutely certain that there would be virtually NO officer who would support such insubordination.  So we created a new page on the website, and offered to allow any veteran not afraid to put his name up on the "Wall of Solidarity" to sign up.  You can see the result at http://www.mikenew.com/battalion.html    If you're a veteran, you might even like to "re-up".

Did you know the case has not yet been resolved?  The "Military Remedy" has been exhausted, after the Army argued before this same court in 1996 that this case is purely military, and does not belong in a civilian court.  And of course, in every military court since then, the Army has argued that this case is purely political, and no issue except obedience can be raised. 

It now resides in United States District Court for the District of Columbia, entitled: 

There are grave Constitutional questions in this case which the Army is incapable of answering, or even understanding.  These questions go to the heart of the matter in terms of who a citizen is, what a nation is, and what sovereignty means.  If American soldiers can be traded as if they were football players, then the concept of national sovereignty has ended.  (Just because that is the fervent goal of the past several administrations does not make it lawful.)  When you reduce a citizen to a mercenary, you destroy the fundamental concept of Freedom.  The attack on U.S. sovereignty has many fronts, both foreign and domestic.

It is not difficult to see that Spc. Michael New understood something his chain of command either did not understand, or refused to face, for the sake of their own careers.  Today we stand on the brink of war, yet again.  We are reaping the fruits of engaging in no-win wars "under the authority of the United Nations" -- a lesson our "leaders" seem incapable of learning.  The argument in Congress seems to dwell on the political question of who will wield the power, rather than who will obey the Law.  Will the US act as the lone policeman of the world, illegally, or will we further empower the United Nations to assume pre-eminence in its bid for a One World Government?  That is a choice between Bad and Worse.  This whole political argument ignores the issue of obedience to an oath of allegiance and to Constitutional Law.

Because of Michael New, the practice of forcing U.S. soldiers to serve in blue berets under foreign officers has been interrupted, and they now go about it in a different manner.  Did you know the United Nations has its own standing army right now?  They call it the "Stand-By High Readiness Brigade."  Look at http://www.shirbrig.dk, where eleven nations have pledged by treaty law to each provide a single brigade of 6,000 soldiers, available upon a phone call from the Secretary General.  Do the math.  That is just a beginning.  Legislation is pending in Congress for the US to provide the first of several such brigades.

In the meantime, the International Criminal Court has claimed jurisdiction over every human being on this planet, and our "leaders", whether out of stupidity or treason, have not taken steps to obey their own oaths of allegiance to the Constitution and to our Sovereign Republic.  Instead, they have pleaded, cajoled and whined that American soldiers should have a grace period, a year of exemption from prosecution.  They say nothing of American civilians.  Do you understand the implications of that little omission?  It means that our "leaders" are in the process of selling us down the river.  They have acquiesced to the illegal, presumed authority of an International Tribunal to be supreme -- rendering our own Supreme Court an "inferior court" on our own territory.  And you and I are now subject to the ICC and its Marxist agenda. 

And our sons and daughters will continue to be placed in harm's way, not to protect a sovereign republic, but to enforce a Global Agenda.  If we let them.
